In this article, we reconstitute the recent emergence of the category “LGBTI refugees” in the international context of rights, allowing to outline a discursive field in which gender and sexuality intersect with the notion of “refugee”. We analyze the relationship between the main refuge instruments in the field of rights and their reinterpretation according to recent developments in the field of sexual rights. The scenario consists of the analysis of documents such as guides and guidelines published in the institutional universe of refuge, particularly the UN Agency for Refugees (UNHCR), thematising sexual orientation and gender identities. At the end, we explore some indications of how such documents are located in the Brazilian context.
